General Terms and Conditions

These general conditions are agreed between Hypercode Enterprise Lda, headquartered at Rua Cidade do Porto, No 12, 4705-084 Braga, tax identification number 515441368, contact (+351) 962 056 060, hereinafter referred to as “Arcada Digital”, and the user of the website.

By accessing the website arcadadigital.pt, or using our services, the user agrees to be bound by these terms.

If the user does not agree with any part of these terms, they must refrain from using the website arcadadigital.pt and our services.

Purpose

1.1 These general conditions aim to provide and define all necessary information for the User regarding payment methods and the provision of services described on the website arcadadigital.pt.

1.2 These conditions ensure the continuation of this service provision between the Contracting Parties.

Payment Terms and Project

2.1 All amounts described in the services are subject to VAT at the legal rate in force.

2.2 The services “Web Design”, “Brand Design” and “Content Creation” require a payment of 50% of the total amount upon approval, and 50% upon final delivery of the project.

2.3 Payment terms for our clients are 14 days up to a maximum of 30 days from the invoice date.

2.4 In case of non-payment, Arcada Digital reserves the right to retain all intellectual property created during the collaboration and revoke the client’s access to social accounts and the website.

2.5 If payment is not received within 14 days after the reminder and the client has a website developed by Arcada Digital, Arcada Digital has the right to take the website offline and charge an indemnity fee for reconfiguring the site.

Limitation of Liability

3.1 All collaborations and information shared between Arcada Digital and the client are under a confidentiality agreement.

3.2 Arcada Digital is not responsible for any damage to equipment on video production sets, and the client is responsible for the safety of all individuals involved during video production.

3.3 The client is responsible for paying typography rights, music rights, and any other applicable royalties.

3.4 The client is responsible for any damages caused to the end consumer by the final product.

3.5 Arcada Digital is not responsible for the logistics and handling of product and website information belonging to the client.

Intellectual Property Rights

4.1 Arcada Digital retains full ownership of the creative work produced for clients, unless the client exclusively pays for the rights, as described in a signed contract.

4.2 Unauthorized use of Arcada Digital’s work without payment entitles Arcada Digital to compensation of 20,000 EUR.

User-Generated Content

5.1 Users are prohibited from posting adult content or abusive language on the website arcadadigital.pt.

Age Restrictions

6.1 The services of Arcada Digital available on the website arcadadigital.pt are intended for individuals over 18 years old or business entities.

Legal and Regulatory Compliance

7.1 Arcada Digital complies with GDPR regulations regarding the protection and processing of personal data.
